Terms and conditions for the Instagram giveaway
§ 1 General
Participation in the giveaway on the Instagram fan page: "Whacky Food Company (instagram.com/whacky_food_company | @whacky_food_company)" (hereinafter referred to as "the Organizer") is only possible subject to these terms and conditions. This giveaway is not sponsored, endorsed, or administered by, or associated with, Instagram.
§ 2 Participation requirements
The competition begins with the publication of the post on Instagram and ends on the date and time specified in the post. The drawing will take place on the date specified in the post. All natural persons of legal age (18 years or older) are eligible to participate. Employees of the organizer and their relatives are excluded from participation. By participating, the entrant agrees that, in the event of winning, their name and/or image may be published online. Participation is only possible within the period specified in the competition description. Legal recourse is excluded.
§ 3 Profit
The prize will be awarded as described in the competition rules. Participants will not incur any additional costs. In the event of multiple correct entries, the winner will be drawn at random, and the judges' decision is final. The prize cannot be exchanged for cash or changed. The winner will be notified via Instagram or as described in the competition rules. If the winner does not respond to the notification within the specified timeframe, the prize will be forfeited without substitution.
§ 4 Liability
Claims for damages against the organizer in connection with the competition are excluded to the extent permitted by law, regardless of the legal basis, unless the organizer has intentionally or grossly negligently breached legal obligations. Furthermore, the organizer is not liable for damages resulting from disruptions to the availability of the competition website due to technical malfunctions beyond its control, force majeure, or attacks by third parties against the competition website. However, the organizer will make every effort to ensure the reliability and functionality of the competition website. The organizer also provides no guarantee that the competition website will function properly on each participant's computer.
Section 5 Data Protection
The organizer guarantees the highest possible data protection standards within the framework of this competition and complies with all relevant legal provisions. The organizer will not forward any personal data to third parties or sell address data. The organizer stores the personal data of each participant solely for the purpose of the competition. The participant hereby expressly declares their consent to the storage and use of the provided personal data for the aforementioned purpose.
§ 6 Severability Clause
Should any provision of these terms and conditions be invalid or should there be a gap in the regulations, this shall not affect the validity of the remaining provisions. The invalid or missing provision shall be replaced by a provision that most closely approximates the intended purpose of the contract and the applicable legal provisions.
§ 7 Jurisdiction / Applicable Law
In the event of disputes, German law shall apply exclusively. The place of jurisdiction shall be the registered office of the organizer, to the extent legally permissible. If the participant does not have a general place of jurisdiction in Germany, or if they move their residence abroad after participation, the registered office of the organizer shall also be the agreed place of jurisdiction.
§ 8 Selection procedure
The winners will be selected at random. Legal recourse is, of course, excluded.
